These Terms of Service (“Terms”) govern your use of The Cake Print Studio website and purchases made through our online store.
Throughout these Terms, “we”, “us” and “our” refer to The Cake Print Studio.
By using our website or placing an order with us, you agree to these Terms. Nothing in these Terms excludes, restricts or affects any rights you have under applicable Irish or European Union consumer law.

2. Our Products
The Cake Print Studio specialises in personalised and made-to-order edible cake decorations, including edible icing toppers, cupcake toppers, drink toppers, photo toppers and other personalised celebration products.
Product photographs and mock-ups are intended to provide a reasonable representation of our products.
As many products are individually produced and printed, minor variations in colour, positioning, sizing or appearance may occur.
Colours displayed on a screen may also vary slightly from the final printed product due to differences between screens, printing processes and edible printing materials.
Nothing in this section affects your statutory rights where a product is faulty or does not conform to the contract.
3. Personalised Orders
Customers are responsible for carefully checking all information submitted when placing an order, including names, ages, dates, spelling, messages, photographs, images, sizes, personalisation instructions and delivery information.
We will generally reproduce personalisation according to the information supplied by the customer.
If incorrect information is supplied by the customer and we produce the order according to that information, we are not responsible for the customer-supplied error.
If we make an error, your statutory consumer rights remain unaffected.
4. Customer-Supplied Photographs, Images & Content
Customers may provide photographs, images, logos, wording or other material for use in personalised products.
By supplying material to us, you confirm that you have the necessary rights, permissions or authority to provide that material and to request its use in your personalised order.
You grant The Cake Print Studio limited permission to use material supplied by you solely as reasonably necessary to create, process and fulfil your order and deal with related customer-service matters.
Customers remain responsible for material they submit.
We reserve the right to refuse or cancel an order where we reasonably believe customer-supplied material may be unlawful, infringe third-party rights or otherwise be inappropriate for us to reproduce.
Nothing in this section transfers ownership of customer-supplied material to The Cake Print Studio.
5. Intellectual Property & Third-Party Rights
Unless otherwise stated, content created and owned by The Cake Print Studio, including our branding, original website content, photographs, graphics and original designs, may not be copied, reproduced, distributed or commercially used without our permission.
Third-party trademarks, character names, characters, logos, artwork, photographs and other intellectual property remain the property of their respective owners.
The Cake Print Studio does not claim ownership of third-party intellectual property and is not affiliated with, sponsored by, authorised by or endorsed by any third-party trademark or copyright owner unless expressly stated.
References to third-party brands, characters or intellectual property do not imply an association, sponsorship or endorsement.
This statement does not claim or create any licence or other right to use third-party intellectual property.
6. Orders
Submitting an order constitutes an offer to purchase the products selected.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
- A product is unavailable
- There is an obvious pricing or listing error
- We cannot complete the requested personalisation
- We reasonably suspect fraudulent activity
- Customer-supplied content cannot reasonably or lawfully be reproduced
- We cannot deliver the order as requested
If we cancel an order after payment has been received and no amount is lawfully due from you, an appropriate refund will be issued.
7. Prices & Payment
Prices are displayed in the currency shown on our website.
Any applicable delivery charges or other charges will be displayed before the order is completed.
Payment must be completed using one of the payment methods available at checkout.
We reserve the right to correct genuine pricing or listing errors. We will not charge an additional amount to an existing order without the customer's agreement.
8. Personalised Products, Returns & Cancellations
Many products sold by The Cake Print Studio are personalised or made specifically to the customer's requirements.
The standard cooling-off/right-to-cancel period applicable to many online purchases does not generally apply to goods made to a consumer's specifications or clearly personalised.
We therefore do not accept change-of-mind returns, exchanges or cancellations once production of a personalised or made-to-order product has begun.
This does not affect your statutory rights if a product is faulty, damaged, not as described, does not conform to the contract or is not delivered.

9. Changes to Personalised Orders
If you need to change your order, contact us at info@thecakeprintstudio.ie as soon as possible.
We will try to accommodate requested changes where production has not begun, but we cannot guarantee that changes will be possible.
Once production of a personalised product has begun, changes may no longer be possible.
10. Delivery
Customers are responsible for providing a complete and accurate delivery address.
Delivery estimates are provided in good faith. Unless a specific delivery date has expressly been agreed as part of the contract, estimated delivery dates are not guaranteed delivery dates.
If your order has not arrived, please contact info@thecakeprintstudio.ie so that we can investigate.
Where we arrange delivery, responsibility for the goods remains with us until they are delivered to you or another person nominated by you to receive them, subject to applicable consumer law.
Nothing in these Terms affects your statutory rights regarding late or non-delivery.
11. Incorrect Delivery Information
Customers are responsible for checking that the delivery information supplied at checkout is correct.
If an order cannot be delivered because the customer supplied an incorrect or incomplete address, reasonable additional delivery charges may apply if the order needs to be resent.
This does not apply where the delivery problem was caused by an error on our part.
12. Damaged, Faulty or Incorrect Products
If your product arrives damaged, faulty, incorrect or materially different from what you ordered, please contact:
Please provide your order number and details of the problem. We may reasonably request photographs of the product and packaging where this will help us investigate the issue.
The appropriate remedy will be provided in accordance with applicable consumer law and may include replacement, price reduction or refund depending on the circumstances and your applicable statutory rights.
Nothing in these Terms excludes or restricts your statutory consumer rights.
13. Edible Products
Customers are responsible for reviewing the product description and any ingredient, allergen or dietary information provided for a product before consumption.
Where a product is advertised as meeting a particular dietary requirement, that description forms part of the product information.
Do not consume a product if you believe it has been damaged, contaminated or stored incorrectly.
Nothing in these Terms limits our obligations relating to food safety or your statutory rights.
14. Customer-Supplied Image Quality
The finished quality of photo or image-based personalised products depends partly on the quality and resolution of the material supplied by the customer.
Low-resolution, blurred, dark, heavily cropped or otherwise poor-quality source images may result in reduced print quality.
Where we accurately reproduce an image supplied by a customer, limitations caused by the quality of the original customer-supplied image are not considered an error made by The Cake Print Studio.
This does not affect your statutory rights where the finished product is faulty or does not conform to the contract.
15. Website Use & Availability
We aim to keep our website accurate, secure and available but cannot guarantee that access will always be uninterrupted or error-free.
We may update, maintain, modify or temporarily suspend parts of the website where reasonably necessary.
Nothing in this section excludes liability or consumer rights that cannot lawfully be excluded.
16. Prohibited Use
You must not use our website:
- For unlawful or fraudulent purposes
- To attempt to gain unauthorised access to our website or systems
- To introduce viruses, malicious code or other harmful material
- To interfere with the security or operation of the website
- To infringe another person's intellectual-property or legal rights
- To provide material that is unlawful or that you do not have authority to provide
We reserve the right to restrict access or refuse an order where reasonably necessary in response to misuse.
17. Third-Party Services
Our website may use services provided by third parties, including Shopify, payment providers, postal and courier providers, analytics providers and social-media platforms.
Certain third-party services may be governed by the relevant provider's own terms and privacy policies.
We are not responsible for independent third-party websites that we do not operate or control.
18. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
Nothing in these Terms excludes or restricts your statutory consumer rights or any liability that cannot lawfully be excluded under Irish or applicable EU law.
We are not responsible for errors or losses resulting solely from incorrect information or material supplied by a customer where we have correctly fulfilled the order using the information provided.
19. Events Outside Our Reasonable Control
We will not be responsible for failure or delay caused by circumstances genuinely outside our reasonable control to the extent permitted by law.
Where such circumstances affect an order, we will take reasonable steps to minimise the impact and communicate with the customer where appropriate.
Your statutory rights, including applicable rights concerning non-delivery, remain unaffected.
20. Returns & Refunds
Returns, refunds, damaged products and non-delivery are governed by our separate Returns & Refund Policy, which should be read together with these Terms.
Nothing in either policy affects your statutory consumer rights.
21. Privacy
Our collection and use of personal information is explained in our Privacy Policy.
Personal information and photographs supplied for personalised products will be handled in accordance with our Privacy Policy and applicable data-protection legislation.
22. Changes to These Terms
We may update these Terms from time to time to reflect changes to our business, products, website, services or applicable law.
The Terms applicable to an order will generally be those in effect when that order was placed, subject to any changes required by law.
23. Governing Law
These Terms are governed by the laws of Ireland.
If you are a consumer resident elsewhere, nothing in these Terms deprives you of mandatory consumer protections that apply to you under applicable law.
24. Severability
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
